Prior Con­sul­ta­tion Law

Law N° 29785 establishes the right of Indigenous peoples in Peru to prior consultation, in line with ILO Convention 169. It obliges the State to consult affected communities before measures impacting their rights, culture, or livelihoods, ensuring participation and dialogue in decision-making.

Creates a mandatory obligation for the Peruvian State (not companies) to consult Indigenous communities before measures that directly affect their collective rights, culture, or livelihoods.  Companies are indirectly impacted, since projects cannot proceed without State-led consultation.
